Following capital murder indictments, Garcia fights death penalty

After an indictment for two separate capital murder charges, a man is fighting to avoid the death penalty.

Xavier Garcia, 22, is accused of killing Katrina Castillo and Kimdrin Jordan last year.

Garcia's attorneys have filed 20 pre-trial motions, including eight to bar the death penalty in these cases. Specifically, court records show his attorneys argue defects in the jury selection procedure violate the Fifth, Sixth, Eighth and 14th Amendments.

Garcia is pleading not guilty in both cases. No trial date has been set.
